AiAir, LLC (DBA Magic Resume™)

By accessing or using Magic Resume™, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Magic Resume™ website and web application (the "Service"). "Magic Resume," "we," "us," and "our" refer to AiAir, LLC (DBA Magic Resume™).

By accessing or using the Service, creating an account, or purchasing a plan, you agree to be bound by these Terms and our Privacy Policy.

2. Eligibility and Account

2.1 Eligibility

You must be at least 16 years old to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2.2 Account security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly through the Support option in the dashboard if you suspect unauthorized access.

2.3 Accurate information

You agree to provide accurate information and keep it up to date. You are responsible for the information you submit and for how you use outputs generated by the Service.

3. Service Description

The Service provides tools to help you create and manage career documents such as resumes, cover letters, executive reports, and related content. The Service may use automation and machine learning to generate or suggest text and formatting.

4. Plans, Billing, and Refunds

4.1 Plans and pricing

We may offer free features and paid plans, including time-based passes and subscriptions. Plan details and pricing are displayed at checkout or within the Service.

4.2 Authorization and renewals

By purchasing a paid plan, you authorize us (and our payment processors) to charge your payment method for the amount shown, including applicable taxes. Subscription plans renew automatically unless canceled before renewal.

4.3 Cancellations

You can cancel subscriptions through your dashboard where available. Cancellation prevents future charges but does not retroactively refund fees already paid, unless required by law or explicitly stated otherwise.

4.4 Refunds

Because the Service delivers digital features and generated content immediately, purchases are generally non-refundable. We may provide a refund or credit in cases of verified technical failure at our sole discretion, unless applicable law requires otherwise.

5. User Content

5.1 Your content

You retain ownership of the content you upload or submit to the Service, such as resume data, job descriptions, and other career information ("User Content").

5.2 License to operate the Service

You grant us a limited, non-exclusive, worldwide license to host, store, process, transmit, and display your User Content solely to provide and improve the Service for you. This license ends when you delete the User Content, subject to reasonable retention for security, backups, and legal compliance.

5.3 Your responsibilities

You represent and warrant that you have all rights necessary to provide User Content and that your User Content does not violate law or third-party rights. Do not upload confidential information you are not authorized to share.

7. AI Outputs and Your Responsibility

The Service may generate content using automation. AI outputs are suggestions and may be incomplete, inaccurate, or inappropriate for your situation.

8. Intellectual Property

The Service, including its software, visual design, logos, templates, and proprietary workflows, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you ownership in the Service.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-transferable license to access and use the Service for your personal or internal business use.

9. Third-Party Services

The Service may rely on third-party services for hosting, authentication, storage, content delivery, analytics, monitoring, and payments. Third-party services may be subject to their own terms and policies. We are not responsible for third-party services outside of our control.

10. Feedback

If you provide suggestions, ideas, or feedback, you grant us a non-exclusive, worldwide, royalty-free license to use and incorporate that feedback without restriction or compensation.

If you believe content on the Service infringes your copyright, contact us through Support and include: (a) your contact information, (b) identification of the copyrighted work, (c) identification of the infringing material and where it appears, (d) a statement of good faith belief, and (e) a statement under penalty of perjury that your notice is accurate and you are authorized to act.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGIC RESUME WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless Magic Resume and its owners, officers, employees, and agents from and against claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service, (b) your User Content, or (c) your violation of these Terms or applicable law.

15. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms, misuse the Service, or create risk for the Service, other users, or us. You may stop using the Service at any time.

Upon termination, your right to use the Service will stop. Sections that by their nature should survive termination will survive, including Sections 5, 8, 12, 13, and 14.

16. Dispute Resolution

16.1 Informal resolution

Before initiating a formal dispute, you agree to contact us through Support and attempt to resolve the issue informally.

16.2 Individual proceedings

To the maximum extent permitted by law, you and Magic Resume agree that disputes will be resolved on an individual basis and not as part of a class, consolidated, or representative action.

16.3 Arbitration (where permitted)

Where permitted by law, disputes arising out of or relating to these Terms or the Service may be resolved through binding individual arbitration instead of court. If arbitration is required or offered, the arbitration will be conducted in English by a neutral arbitrator and any award may be entered as a judgment in a court of competent jurisdiction.

17. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of laws principles, except where prohibited by applicable law.

18. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the "Last Updated" date. Your continued use of the Service after changes become effective means you accept the updated Terms.
